Our success is your success. Business Law is a generic term which can involve a variety of legal practice areas, including the California Corporation’s Code, Intellectual Property Law (including trademarks and copyrights), the California Commercial Code (UCC), Employment laws, the California Business and Professions Code, general legal principles governing Contract interpretation and enforcement, Securities laws, E-commerce laws, and many more. Generally speaking, business law attorneys address matters which often involve a combination of legal and regulatory authority. One of our challenges, and a focus at Gehres Law Group, is to identify complex issues and simplify them as much as possible for our clients–making the law work for you, not the other way around.

Experience Matters. If you are involved in a costly business-related dispute or lawsuit, we understand that you don’t want novice attorneys or paralegals making decisions that affect your case. You want business litigation attorneys (trial lawyers) with decades of legal experience and proven results. While every contract and legal document we draft is prepared with an eye toward preventing disputes and protecting our clients from lawsuits, some relationships inevitably break down, leading to conflicts and/or litigation.

Our business litigation attorneys provide each client with an honest appraisal of their case, the potential risks, costs, and possible outcomes, depending on how the clients’ case develops, whether through mediation, arbitration, litigation, or simple negotiations absent a formal legal proceeding. No two cases are the same, but over the years, our trial lawyers have developed a keen sense for developing the best strategy for each type of dispute they may encounter, adding value to client outcomes and often saving clients a great deal of unnecessary time and expense.

The commercial law, including the California Uniform Commercial Code (“UCC”), embodies the rules and regulations that you and other merchants are bound to when engaging in a variety of transactions. Commercial law is one aspect of business law and is often handled by a business attorney. Many legal documents involve provisions which are governed by commercial law, as well as other business-related practice areas. Therefore, commercial law may come into play not only from a transactional perspective, but also when parties are involved in litigation, as these laws will often dictate the rights and responsibilities of the litigants.
How Can the Gehres Law Group Attorneys Help You?

Our attorneys always provide a free evaluation of each client matter and will explain to you how the law applies to your situation, while advising you on strategies, or a particular course of action, which is designed to protect your legal rights and achieve a successful outcome. As in most civil litigation matters, achieving a successful outcome in a dispute involving transactions or agreements governed by commercial laws begins by gathering all relevant documentation and information so our commercial law attorneys have a thorough understanding of your case, your business, and how your case may affect your business. Once this process has been completed, we will be in a position to formulate the best strategies and options available. While few cases actually go to trial, if the facts and law support your case, pushing your case to trial may be the best option. However, there are many other possible alternatives, including mediation, arbitration, pursuing a demurrer, motion to dismiss, motion for summary judgment, or other pleadings geared to achieving the best results for you.

Do you have a book or other idea you would like to publish? This is just one example of a situation in which the issue of copyright registration should be considered.
Why Is Copyright Registration Important?
The body of laws governing the rights and responsibilities of authors/owners of creative works are generally referred to as Copyright law. These laws were developed to protect the author/owner of all creative expressions that are fixed in a tangible medium. Copyrights are not meant to protect the idea itself, but your expression of the idea. This means that if you want to print a book, a copyright will not protect your idea for the book, but it will protect the expression within the book, the text inside it. Your work, whether a book, software code, dramatic works, including any accompanying music, pantomimes and choreographic works, pictorial, graphic, or sculptural works, a motion picture or other audiovisual work, sound recordings, architectural works, or engineering designs, will be protected by copyright laws whether it is in a printed, tangible form or is published electronically.
While authors/owners of creative ideas receive the benefit of copyright laws without registration, there are a number of additional advantages to formally copyrighting your works. These advantages include: 1) Permitting the author or owner to bring a claim of infringement against others; 2) Defeating a claim of “innocence” by an infringer; and, 3) Simplifying the process to prove a claim of infringement. Estate planning allows individuals and families to manage their assets and property in the best possible way during their lifetime and beyond the incapacity or death of any one individual. Engaging in the estate planning process involves considering not only to whom your assets will pass, but also when your assets will be distributed, who will manage your assets and make distributions when you are no longer able to do so, who will make medical and financial decisions if you become incapacitated, and a myriad of other issues. If you do not have an estate plan when you pass, the distribution of your assets will be determined by state law pursuant to intestate succession laws. Since these “default” laws require full probate and the decedent gets no say in when, to whom, and by whom his/her assets are distributed, passing away without estate planning documents in place is generally not an attractive result for most adults. In addition, the time, expense, and other burdens of full probate on the surviving family and friends is typically avoidable and a process most people want to avoid.
If you are from California and your assets exceed $150,000, you should have an estate plan. If you have children or own real property, then an estate plan is also highly recommended regardless of the value of your assets.

There a variety of distinct types of trademark litigation proceedings, including: 1) District Court Litigation where owners of a trademark might bring a claim of federal trademark infringement against others who are alleged to have engaged in infringement activities; 2) Cancellation Proceedings, which is an administrative proceeding, somewhat like a federal lawsuit, and takes place before the Trademark Trial and Appeal Board (“TTAB”). These proceedings are typically brought in an effort to cancel a trademark, as the name implies; and, 3) Opposition Proceedings: similar to a cancellation proceeding, except that it involves trademarks which have a “pending” application with the United States Patent and Trademark Office (“USPTO”) but have not yet registered.

No matter your industry or the service and products you offer, registering your trademarks is a critical step in establishing a brand that is recognizable and respected, as well as protecting that brand and associated goodwill which you have worked so hard to develop.
Why Is Trademark Registration Important?
You may have heard that you establish rights to a trademark as soon as you begin using it. While this is generally a true statement, common law rights established by use of a trademark are fairly weak compared to the rights you receive when you formally register your trademark. Our leading trademark attorney summarizes her top 10 reasons for registering your trademark, here, which include: national priority, deterrent against infringement, presumption of ownership, incontestability, use of the ® symbol, litigation damages, exclusivity, automatic right to sue, and more.
